EPA pledges actions on tolerances for ProFume residues on food
EPA is expected to publish a document in November describing agency action regarding the future of sulfuryl fluoride (SF or Dow AgroSciences trade name ProFume). In a letter from EPA Assistant Administrator Stephen Owens to objectors to the final rule establishing sulfuryl fluoride tolerances he provided a plan of action which included a federal register notice in November.
Specifically, it appears the agency will propose to revoke the tolerances for SF residues on food, invite public comments and possibly take action at a later date. If the food tolerances are revoked, NAMA expects FDA would follow its “Channels of Trade” policy to allow some time for residue-containing foods already in commerce to work their way out of the marketplace. (FDA’s policy is available at
http://www.fda.gov/Food/GuidanceComplianceRegulatoryInformation/
GuidanceDocuments/ChemicalContaminantsandPesticides/ucm077918.htm.)
EPA’s action is forced by what was first a petition and later a legal challenge over the agency’s tolerances for fluoride residues on foods. In response, EPA conducted a new risk assessment of fluoride in the diet. The government has concluded that fluorosis (over-exposure to fluoride) is no longer a “cosmetic effect” but rather is an “adverse health effect.” This triggered remedial action by the agency under the Safe Drinking Water Act.
If EPA revokes the tolerances for SF residues on food, it would still be technically legal to fumigate a mill with SF. However, milled grain products or other foods with SF residues at any level would be considered adulterated by FDA. This would include small amounts of product remaining in the milling system during fumigation that is exposed to the fumigant and later finds its way into commerce.
NAMA is in regular contact with Dow, our pesticide counsel and the government, and will notify the membership as soon as the EPA proposal is announced.
